Terms of Service

These Terms of Service ("Terms") are a legally binding agreement between you and SeriousPixel, LLC ("SeriousPixel," "we," "us," or "our") governing your access to and use of Visual Word Bible, including our website at www.visualwordbible.com (the "Site"), our mobile, desktop, and web applications (the "App"), and all related content, features, and services (collectively, the "Services").

Please read these Terms carefully. By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not access or use the Services.

1. Company information

2. Eligibility

You must be at least 13 years old to use the Services, or the age of digital consent in your jurisdiction if higher. If you are under 18, you represent that you have permission from a parent or legal guardian to use the Services and that your parent or guardian agrees to these Terms on your behalf.

By using the Services, you represent and warrant that you meet these requirements and that your use complies with all applicable laws and regulations.

3. The Services

Visual Word Bible provides software and digital content for reading, listening to, studying, and engaging with Scripture and related resources. Features may include verse-by-verse narration, study tools, notes, highlights, maps, audio content, podcasts, music, and other materials.

We may offer free and paid tiers, subscriptions, lifetime purchases, and promotional access. Features, content, pricing, and availability may change at any time. Some features described on the Site may be marked as forthcoming and are not yet available.

We may release beta, preview, or pre-release features. Such features are provided as-is, may contain errors, and may be modified or discontinued without notice.

4. Accounts

Certain features require an account. You agree to provide accurate, current, and complete information and to keep your account information updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

You must notify us promptly of any unauthorized use of your account or any other breach of security. We are not liable for losses arising from unauthorized use of your account where you have failed to safeguard your credentials.

We may suspend or terminate accounts that violate these Terms or that we reasonably believe pose a risk to the Services or other users.

5. Subscriptions, purchases, and billing

If you purchase a subscription or other paid access, you agree to pay all applicable fees and taxes. Prices are shown at the time of purchase and may change for future billing periods upon notice as required by law or platform rules.

Payments made through the Apple App Store, Google Play, or other third-party platforms are processed by those platforms and are subject to their terms and refund policies. SeriousPixel does not control platform billing and cannot override platform refund decisions except as required by law.

Subscriptions automatically renew unless canceled before the end of the current billing period through your account settings or the applicable app store. You may cancel at any time; cancellation takes effect at the end of the current paid term unless otherwise stated.

Except where required by law or expressly stated in a separate offer, all fees are non-refundable. We may offer free trials or promotions subject to additional terms disclosed at signup.

6. License to use the Services

Subject to your compliance with these Terms, SeriousPixel grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services for your private, personal, non-commercial use only (or, if you are an organization with a separate written agreement, as specified in that agreement).

Unless you have a separate written license from SeriousPixel, the Services and all content made available through them — including Scripture text, audio narration, music, video, visuals, study materials, and related media — are licensed for individual private use. They are not licensed for public use, public performance, or use in any setting where content is displayed, played, or made available to an audience.

Except as expressly permitted, you may not:

  • Copy, modify, distribute, sell, lease, or sublicense any part of the Services;
  • Reverse engineer, decompile, disassemble, or attempt to derive source code from the Services, except to the extent such restriction is prohibited by applicable law;
  • Remove, alter, or obscure proprietary notices;
  • Use the Services to develop a competing product or service;
  • Use automated means to access, scrape, or harvest data from the Services without our prior written consent;
  • Circumvent access controls, security measures, or usage limits;
  • Publicly perform, display, broadcast, stream, project, or otherwise make available any audio, video, text, or visual content from the Services to an audience, including in worship services, classes, meetings, events, or online streams;
  • Use the Services or its content in any public, congregational, organizational, or commercial setting without a separate written license from SeriousPixel;
  • Use the Services in any unlawful manner or in violation of these Terms.

All rights not expressly granted are reserved by SeriousPixel and its licensors.

7. User content

The Services may allow you to create, upload, store, or share content such as notes, highlights, tags, journal entries, and preferences ("User Content"). You retain ownership of your User Content, subject to the license below.

You grant SeriousPixel a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, sync, and process your User Content solely as necessary to operate, provide, maintain, and improve the Services and as otherwise described in our Privacy Policy.

You represent and warrant that you have all rights necessary to submit your User Content and that your User Content does not violate any law or infringe any third-party rights.

We may remove or disable access to User Content that we reasonably believe violates these Terms or applicable law.

8. Acceptable use

You agree not to use the Services to:

  • Violate any applicable law, regulation, or third-party rights;
  • Upload or transmit malware, harmful code, or disruptive content;
  • Interfere with or disrupt the integrity or performance of the Services;
  • Attempt to gain unauthorized access to systems, accounts, or data;
  • Harass, abuse, threaten, or impersonate others;
  • Use the Services for unauthorized commercial purposes or public performance without a separate license;
  • Misrepresent your affiliation with any person or entity.

9. Intellectual property

The Services, including the Visual Word Bible name, logos, branding, software, design, text, graphics, audio, video, translations, study materials, and all related intellectual property, are owned by SeriousPixel or its licensors and are protected by copyright, trademark, and other laws.

Nothing in these Terms transfers any ownership interest in the Services or our intellectual property to you.

10. Scripture, audio, and third-party content

Bible translations, audio narrations, study resources, maps, images, podcasts, music, and other materials made available through the Services may be owned by SeriousPixel or licensed from third parties. Such content is provided for private, personal use through the Services only and may not be copied, redistributed, publicly performed, or exploited outside the Services except as expressly permitted by us or the applicable licensor.

Public use and performance are prohibited. Without a separate written license, you may not play, display, project, broadcast, stream, or otherwise perform Visual Word Bible content — including narration, music, video, or on-screen visuals — in any public or semi-public setting. This includes, without limitation, church worship services, Bible studies open to a group, classrooms, conferences, retreats, outreach events, and live or recorded online broadcasts where an audience can view or hear the content.

Churches and organizations. If your church, ministry, school, or other organization wishes to use Visual Word Bible content in a public or group setting, you must obtain a separate license from SeriousPixel. Standard consumer subscriptions and personal accounts do not include public-performance or organizational-use rights. To inquire about special licensing, pricing, and permitted uses, contact us at [email protected] with the subject line "Public Use Licensing" and a brief description of your intended use.

Third-party translations and resources may be subject to separate attribution or license terms, which we will honor and may display within the Services. Third-party names, marks, and content remain the property of their respective owners.

11. No religious, pastoral, or professional advice

The Services are provided for informational, educational, and devotional purposes only. Visual Word Bible is software and digital content; it is not a church, ministry, counselor, or theological authority. Nothing in the Services constitutes religious, pastoral, legal, medical, or other professional advice. You are solely responsible for your own study, interpretation, and decisions.

12. Privacy

Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

13. Third-party services and links

The Services may integrate with or link to third-party websites, platforms, payment processors, analytics providers, or other services. We do not control and are not responsible for third-party services. Your use of third-party services is at your own risk and subject to their terms and policies.

14. Copyright complaints

If you believe content available through the Services infringes your copyright, please send a notice to [email protected] with sufficient detail to identify the work, the infringing material, your contact information, and a statement of good-faith belief and accuracy under penalty of perjury. We may remove or disable access to material that is the subject of a valid complaint and may terminate repeat infringers where appropriate.

15. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, SERIOUSPIXEL DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT, AND ACCURACY.

We do not warrant that the Services will be uninterrupted, secure, error-free, or free of harmful components, or that any content will be complete, current, or free from errors. Downloaded or offline content is provided at your own risk.

16. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SERIOUSPIXEL AND ITS OFFICERS, DIRECTORS, MEMBERS, EMPLOYEES, AGENTS, LICENSORS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO SERIOUSPIXEL FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US $100).

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

17. Indemnification

You agree to defend, indemnify, and hold harmless SeriousPixel and its officers, directors, members, employees, agents, licensors, and suppliers from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, your User Content, or your violation of these Terms or applicable law.

18. Dispute resolution and arbitration

Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court.

Except for disputes that qualify for small claims court or requests for injunctive relief relating to intellectual property or unauthorized access, you and SeriousPixel agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved by binding arbitration on an individual basis, rather than in court, except where prohibited by law.

Arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect. The arbitration will take place in Tennessee or another location mutually agreed by the parties, unless applicable law requires a different location. The arbitrator's decision will be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.

Class action waiver. You and SeriousPixel agree that each may bring claims against the other only in an individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding.

You may opt out of this arbitration agreement within thirty (30) days of first accepting these Terms by emailing [email protected] with subject line "Arbitration Opt-Out" and your name, account email, and a clear statement that you wish to opt out. If you opt out, the arbitration and class action waiver provisions will not apply to you, but the remaining Terms will.

19. Governing law and venue

These Terms and any dispute not subject to arbitration are governed by the laws of the State of Tennessee, without regard to conflict-of-law principles. Subject to Section 18, you agree that the state and federal courts located in Tennessee shall have exclusive jurisdiction over any permitted court proceeding, and you consent to personal jurisdiction in those courts.

20. Export controls

You may not use, export, re-export, or transfer the Services except as authorized by United States law and the laws of the jurisdiction in which the Services were obtained. You represent that you are not located in a country subject to U.S. embargo and are not listed on any U.S. government restricted-party list.

21. Termination

You may stop using the Services at any time. We may suspend or terminate your access to the Services, in whole or in part, at any time if we reasonably believe you have violated these Terms, pose a risk to the Services or others, or where required by law.

Upon termination, your license to use the Services ends. Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, indemnification, dispute resolution, and governing law.

22. Changes to the Services and Terms

We may modify, suspend, or discontinue the Services at any time. We may update these Terms from time to time. If we make material changes, we will provide notice as appropriate, such as by posting updated Terms on the Site or within the App. Your continued use of the Services after the effective date of updated Terms constitutes acceptance, except where applicable law requires otherwise.

23. General

  • Entire agreement. These Terms and the Privacy Policy constitute the entire agreement between you and SeriousPixel regarding the Services and supersede prior agreements on the subject.
  • Severability. If any provision is held invalid or unenforceable, the remaining provisions remain in full force and effect.
  • No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
  • Assignment. You may not assign these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
  • Force majeure. We are not liable for delay or failure due to events beyond our reasonable control.
